This presentation will provide a summary of all recent material developments applicable to emissions of air pollutants under the Clean Air Act and interpreting case law most critical to attendees. Specifically, the presenter will provide a summary of significant regulatory developments and court cases including: Global Climate Change (impacts of the U.S. Supreme Court's Massachusetts v. EPA decision and U.S./EPA policies to address climate change); New Source Review (proposed clarifications and modifications to modeling procedures, ?reasonable possibility standard? in recordkeeping and EPA response to the U.S. Supreme Court's Environmental Defense v. Duke Energy decision - should applicability be based upon annual emissions or an hourly emission rate?); Air Toxics (SOCMI implementation and status of ?once major, always major?); NAAQS Implementation (ozone, PM10, PM 2.5 implementation, and assuring compliance with NAAQS standards prior to final EPA implementation rulemakings); CAIR, CAVR and CAMR (federal/state implementation issues).
